2.2 All Healthcare Providers using the MEDIVA platform are independent contractors and are solely responsible for their services, including the quality of care provided.
3. User Responsibilities
3.1 Users must be at least 18 years of age or have parental consent to use the Services.
3.2 Users agree to provide accurate, complete, and current information when creating an account and using the Services.
3.3 Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
4. Intellectual Property
4.1 All intellectual property rights associated with the MEDIVA website, including its content, design, software, trademarks, and logos, are owned exclusively by MEDIVA. This includes all rights, titles, and interests in the Services and any materials provided on the website. Users are granted a limited, revocable, non-transferable, and non-exclusive license to access and use the website and its content solely for personal, non-commercial purposes.
4.2 Users may not reproduce, distribute, modify, or create derivative works based on any intellectual property belonging to MEDIVA without prior written permission. Unauthorized use of MEDIVA’s trademarks, service marks, or any proprietary materials is strictly prohibited. All rights not expressly granted herein are reserved by MEDIVA.
5. Payment and Refund Policy
5.1 All payments for Consultation services must be made in advance through the MEDIVA platform. Users will receive confirmation of their payment via email.
5.2 Once a Consultation has been completed, no refunds will be issued. Users are encouraged to ensure they are fully prepared for their Consultation prior to scheduling.
6. Limitation of Liability
6.1 MEDIVA shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Site or Services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
6.2 MEDIVA does not guarantee the accuracy, reliability, or completeness of any information provided by Healthcare Providers during Consultations.
7. Indemnification
Users agree to indemnify, defend, and hold harmless MEDIVA and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising out of or related to their use of the Site or Services, violation of these Terms, or infringement of any rights of any third party.
8. Changes to Terms
MEDIVA reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site and Services after any changes constitutes acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Virginia, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the state of Virginia.
